Horvath Communications Wins Court Battle
Decision Clears Way for Cell Phone Tower
South Bend, IN-A LaPorte, IN Judge has reversed a zoning decision that blocked the
construction of a wireless communications tower in the city of LaPorte. Superior Court Judge
Steven King ruled Horvath Communications of South Bend, IN met all statutory requirements
and the LaPorte Board of Zoning Appeals had no discretion to deny the application for a
special use permit to construct the tower. Judge King also ordered the BZA to issue the
permit to Horvath Communications within 30 days of his order.
Horvath Communications, a leading developer and manager of wireless cell phone towers in
the Midwest, filed an application for a special use permit to build a199 foot tower on the
south side of Clear Lake in October of 2005. The LaPorte Board of Zoning Appeals denied
the application in February, 2006 citing unsubstantiated concerns for “public safety.” In his
written ruling Judge King dismissed those concerns: “the board’s finding and
determination lacks evidentiary support, is clearly erroneous, constitutes an abuse of
discretion, and must be reversed.”
“We’re pleased with the Judge’s decision,” said Company President Jackie Horvath. “Cell
phone towers are in no way a threat to public safety, in fact just the opposite is true. The
towers help ensure people get the help they need when making an emergency call on their
cell phone. I think the City of LaPorte would consider that vital, especially in a recreational
area like Clear Lake.”
